CPESR Inc. Terms and Conditions (Hereinafter "CPESR")
Free Retake Policy:
The Student may retake the CPESR course (does not include Test Center only purchases), free of charge one (1) additional time if the Student meets all of the following conditions:
- The Student must watch and understand at least 65% of the instructional videos and take the corresponding quizzes for each section.
- The Student must also take all of the practice exams and score at least 65% on one of them.
- The California Civil Surveying Exam must be taken within 6 months from the conclusion of the course to be considered for the free retake.
- The free retake must be redeemed within one year after taking the course.
- The Student must submit proof to CPESR that he/she has taken the California Civil Surveying Exam and did not pass the exam.
- CPESR must receive proof of failure of the exam. This proof may be submitted via email to [email protected].
Only when all of these conditions are met, will the free retake be honored.
Copyright Policy:
All services provided by CPESR may be used for lawful purposes only. Transmission or storage of any information, data, or material in violation of any United States law is prohibited. This includes, but is not limited to: CPESR videos, reference manuals, practice tests, section quizzes, and website content. Student agrees that by failing to comply with this policy, he/she shall be assessed a penalty of not less than $10,000.00. In accordance with the Digital Millennium Copyright Act of 1998 (the text of which may also be found on the U.S. Copyright Office web site at http://lcweb.loc.gov/copyright/.
Guarantee Policy:
CPESR does its best job to provide up-to-date accurate material regarding the California Civil Surveying Exam. However, CPESR makes no guarantees of any kind, whether expressed or implied, for the service it is providing. CPESR will not be responsible for any damage(s) suffered including failure to pass the California Engineering Surveying Exam. CPESR is not an entity of the California Board of Professional Engineers, Land Surveyors, and Geologist.
Fee Refund Policy:
Due to the nature of online content, the fact that sample work is displayed on the CPESR website, and because reference manuals are immediately shipped out, there is no refund. Extraordinary situations will be reviewed case by case but not guaranteed.
Interruption of Service:
The Student hereby acknowledges and agrees that CPESR will not be liable for any temporary delay, outages or interruptions of the CPESR course. Further, CPESR shall not be liable for any delay or failure to perform its obligations under this Agreement, where such delay or failure results from any act of God or other cause beyond its reasonable control.
Termination of Service:
All CPESR courses and practice material will be terminated on the expiration date as shown on the Dashboard and Profile page. CPESR reserves the right to terminate any customer and any and all services for any reason. CPESR will use best efforts to notify affected Student(s) to prevent any interruption of service and will make all reasonable efforts to offer Student(s) comparable options that will enable CPESR to continue service.
Non-solicitation:
During the Term hereof and for a period of four (4) years thereafter, the Student agrees not to hire, solicit nor attempt to hire or solicit the services of any employee, subcontractor or vendor of CPESR without the prior written consent of CPESR.
Non-compete:
The Student acknowledges that CPESR may, in reliance of this agreement, provide the Student access to trade secrets and other confidential data and good will. The Student agrees to retain said information as confidential and not to use said information on his or her own behalf or disclose same to any third party. The Student also agrees to take reasonable security measures to prevent accidental disclosure. The Student shall not own, manage, operate, consult or be employed in a business substantially similar to, or competitive with, the present business of CPESR or such other business activity in which CPESR may substantially engage during the term of the course and for a period of four (4) years thereafter.
Disputes:
Any disputes, claims, or actions arising out of or relating to this Terms and Conditions shall be governed by the laws of the State of California. To resolve any such dispute, the Student agrees to submit to personal jurisdiction in Los Angeles County, California even if the Student’s residence is in another county, state or country. The Student agrees that the state codes in Los Angeles County, California shall be the exclusive forum for any dispute.
Refusal of Services:
CPESR, Inc. reserves the right to refuse service to anyone for any reason.
